Terms of Service

Big Funnel is a software platform owned and operated by Arthatech Softwares LLP (“Arthatech”, “we”, “us”). These Terms govern access to and use of the Big Funnel platform.
1. Agreement
By accessing or using Big Funnel, the customer agrees to these Terms and any order form or service schedule accepted by Arthatech. If you use Big Funnel for an organization, you confirm you have authority to bind it.
2. The service
Big Funnel provides CRM, marketing, sales, automation, communications and analytics capabilities. Features, integrations and deployment scope may vary by plan or order form.
3. Accounts and acceptable use
Customers must keep credentials secure, provide accurate account information and use the service lawfully. Customers must not interfere with the platform, attempt unauthorized access, introduce harmful code, misuse communications features or process data without a lawful basis.
4. Customer data
Customers retain ownership of their data and grant Arthatech the limited rights needed to host, process, transmit and display it to provide and support Big Funnel. Customers are responsible for the legality, accuracy and permissions relating to that data.
5. Fees and taxes
Fees, billing frequency and deployment charges are stated in the applicable order. Unless the order says otherwise, fees are non-refundable and exclude applicable taxes.
6. Intellectual property
Arthatech and its licensors retain all rights in Big Funnel, including its software, design, documentation, trademarks and improvements. No ownership rights are transferred to customers.
7. Third-party services
Integrations and third-party services are governed by their providers’ terms. Arthatech is not responsible for changes, outages or acts of those providers.
8. Confidentiality
Each party will protect the other party’s confidential information, use it only for the relationship and disclose it only to people who need it and are bound to protect it, except where disclosure is legally required.
9. Warranties and liability
To the extent permitted by law, the service is provided “as is” and implied warranties are disclaimed. Neither party is liable for indirect, incidental, special or consequential loss. Any liability cap and specific service commitments should be stated in the applicable order or master services agreement.
10. Suspension and termination
Arthatech may suspend access for security risks, unlawful use or material non-payment. Either party may terminate as allowed by an order form or for an uncured material breach. Provisions that should reasonably survive termination will survive.
11. Governing law
These Terms should specify the governing law, courts and dispute process agreed by the parties in the final executed contract.
